Relief to Bona fide suppliers in fake invoicing web

Many are caught in the web of fake invoices. GST departments all over India are passing orders against the entities which were engaged in fake transactions to wrongfully gain from the scheme of ITC. Caught in the midst of these orders are some genuine bona fide buyers and sellers. Adv. Vaibhav Gogra acts on one of the such matter wherein a bona fide buyer was alleged to have recieved fake invoices without actual supply of goods. Vaibhav produced all the relevant documents and argued that bona-fide buyers could not have seen the fake nature of its suppliers. Not all transactions effected by the said supplier can be considered fake, some transactions are genuine and have been effected in full accordance of the law. Appellate Authority was pleased to set aside the order on the grounds mentioned in the appeal memo and gave substantial relief to the appellant.
